Submit your own ‘I Like NESCAF
É Samalamig’ Photo, narrate your experience and accumulate as much “likes” from your friends to get a chance to win cool prizes. The top three (3) Samalamig Photos chosen by fans and judges will win an iPad.
QUALIFICATION / DISQUALIFICATION OF PARTICIPANTS:
- Promo is open to all Filipino citizens or Philippine residents, at least 18 years of age at the time of joining.
- Participants must be a member of Facebook and like the NESCAFE PHILIPPINES Facebook Fan page.
HOW TO JOIN:
- Be a member of Facebook and like the NESCAFÉ PHILIPPINES Facebook Fan page.
- Submit an essay about your experience in preparing a particular SAMALAMIG DRINK using the recipe found at NESCAFE Samalamig website (http://www.nestle.com.ph/nescafe/samalamig/) and upload a photograph of you consuming the Samalamig drink you prepared.
- The essay must be composed of a maximum of 100 words:
- Answering the questions “What was your experience like in preparing your NESCAFE Samalamig Drink?” and “How did your NESCAFE Samalamig drink taste?”
- Ending with the sentences: “My name is ___ and I like NESCAFE Samalamig (insert name of recipe here). Click on Like below my Nescafe Samalamig Photo and I might win one of 3 iPads!”
- The essay should specifically state the particular SAMALAMIG DRINK you prepared, limited to recipes found at NESCAFE Samalamig website ((http://www.nestle.com.ph/nescafe/samalamig/) and enumerated herein:

- Go Go Sago

- The photograph must be a single capture of not more than 3 persons, one of whom must be the person joining this promotion, featuring the persons (one of whom must be the contestant) drinking the SAMALAMIG DRINK. The SAMALAMIG DRINK featured in the photograph must have clear resemblance with the SAMALAMIG DRINK as captured in the NESCAFE Samalamig website (http://www.nestle.com.ph/nescafe/samalamig/)
- Qualified entries shall be posted in the ‘I Like NESCAFE Samalamig’ photo album found in the NESCAFÉ Philippines Facebook Fan Page from 11 May 2010 12:01 pm server time until 11 June 2010 11:59 server time.
- During the duration and at any stage of the promotion, Nestlé Philippines, Inc. (NPI) reserves the right to disqualify contestants who fail to qualify with the abovementioned qualifications. The decision of NPI on this matter is final.
- Deadline for submission of entries is on June 6, 2010.
HOW TO PARTICIPATE:
- To submit an essay and a photo, contestants must email their entries as well as the following information to nescafe@samalamig.com:
- Full name of the contestant;
- Date of birth;
- Complete home address, which must be in the Philippines and not be a P.O. Box, and contact number(s);
- Valid e-mail address;
- Link to their Facebook profile
- The “Subject” part of the email of the contestant must contain his or her full name as well as the complete name of the SAMALAMIG Drink he or she prepared as specified in the NESCAFÉ Samalamig website (http://www.nestle.com.ph/nescafe/samalamig/).
Example: (Name of Contestant): (Name of Samalamig Drink)
- By submitting an entry, the contestant attest that he or she has read the full mechanics and agrees to abide by the terms and conditions of this promotion as specified in the NESCAFÉ Samalamig website (http://www.nestle.com.ph/nescafe/samalamig/) and the NESCAFÉ Philippines Facebook Fan Page.
- A contestant can only submit one (1) essay with one (1) accompanying photograph for every drink found in the NESCAFE Samalamig website (http://www.nestle.com.ph/nescafe/samalamig/). Maximum of eight (8) entries per contestant. Both the essay and the accompanying photo must be qualified.
- The essays and the photos must meet all of the following minimum requirements:
- Essay must not exceed 100 words written in English and Filipino;
- Essay must always be accompanied by one (1) photo of the contestant consuming the SAMALAMIG DRINK;
- The photo (s) must not exceed 2MB in file size;
- The photo must include a product package of NESCAFÉ CLASSIC. Except for NESCAFÉ CLASSIC, no other product is displayed or featured in the photograph;
- Should the photo include images of person/s other than the contestant, the photo must not include pregnant women or child/children below seven (7) years of age;
- No infant formula or breast milk substitutes, including bottle-fed complementary foods, as well as teats and other commodities which intend to replace or substitute, in whole or in part, breast milk and breastfeeding is shown;
- No sip cup or milk-feeding bottle is featured;
- The photos should be clear and contain wholesome images;
- NPI will incorporate all qualified photos into a standard Samalamig template.
- Within 24 hours from receipt of the email of the contestant, Virus Incorporated, the website administrator, shall send the contestant an electronic data message (eDM) informing them the contestant if he or she is qualified to join or not and whether his or her entry/s meet the minimum requirements for participating in the promotion or not. The decision of NPI and the website administrator on this regard shall be final.
- Qualified essay and photo entries shall be uploaded in the ‘I Like NESCAFE Samalamig’ Photo Album in NESCAFE Philippines Facebook Fan Page from 11 May 2010 12:01 pm server time until 11 June 2010 11:59 server time.
- Contestants with qualified entries can “share” their submission on Facebook as soon as the same is/are approved. NPI reserves the right to disqualify an entry, refuse the publication of and/or remove an entry in the NESCAFE Philippines Facebook Fan Page as it deems fit and just and its decision on the matter is final.
HOW TO WIN:
- The entries that garnered the Top Fifty (50) highest numbers of “likes” shall be entitled to move on to the next level. The “likes” garnered by a particular entry from 11 May 2010 12:01 pm server time until 11 June 2010 11:59 server time shall be the only ones counted for this promotion. The number of “likes” garnered shall be recorded electronically. The number of likes shall be tallied electronically in the presence of a Food and Drug Administration (FDA) representative. The decision of NPI on this regard is final.
- Contestants with qualified entries shall be responsible for promoting their entries on Facebook. In doing so, he or she expressly agree that he or she is allowing himself or herself to be a subject matter of varying comments, views and opinions of people, which may be expressed or relayed not just in the NESCAFÉ Philippines Facebook Fan Page, but in other ways and medium, including but not limited to blogs. Accordingly, he or she undertakes not to hold responsible NPI and the third party contractors running this promotion for the same.
- The NESCAFE Philippines Facebook Fan Page is provided on an "As Is" and "As Available" basis and NPI gives no warranties of any kind, whether express, implied, statutory or otherwise including warranties or representations that materials found on the links therein, including those provided by the contestants will be complete, accurate, reliable, timely, non-infringing to third parties; that access to the links found therein, including those provided by the contestants will be uninterrupted or error-free; that the links found therein, including those provided by the contestants will be secure; that any advice or opinion obtained from links found therein, including those provided by the contestants, is accurate or to be relied upon and any representations or warranties thereto are expressly disclaimed.
- For disqualified entries, an e-mail notification will be sent informing them of such disqualification and the basis thereof. Despite the disqualification, the registrant may still submit a new entry or a modified one provided that he/she submits the same before the deadline for submission of entries.
- On 14 June 2010, a panel of judges composed of five (5) members from NPI and Agency partners shall select three (3) winners from the Top fifty entries based on the following criteria and in the presence of an FDA representative:

- The top three (3) entries chosen by the panel of judges shall be subjected to verification. By verification, website administrator will contact the winner via telephone (landline or mobile) to verify whether he/she joined the contest. If he/she replied in the affirmative within 24 hours from first attempt to contact him or her, website administrator shall inform him/her that the entry he/she submitted won. If he/she replied in the negative within 24 hours from first attempt to contact him or her, website administrator shall move on to the next contestant whose entry was selected by the judges. If website administrator cannot reach the contestant through the contact numbers he or she provided within 24 hours from first attempt to contact him or her, website administrator shall move on to the next contestant with a winning entry. Website administrator shall proceed with the verification until such time that it verifies three (3) winning entries.

PROCEDURE IN THE NOTIFICATION OF WINNERS
- The names of duly verified winning contestants shall be announced at the Facebook page of NESCAFÉ Philippines and the NESCAFÉ Samalamig website (http://www.nestle.com.ph/nescafe/samalamig/) on 01 June 2010. The winners shall receive email notifications. Each winner shall receive one (1) 16 GB IPad (1year warranty).
- The prizes will be delivered to the winners at the address they indicated in their emails.
- The description of the prizes is based solely on information provided by third party manufacturers/suppliers. Likewise, with regard to the reliability of the quality of the prizes, NPI/website administrator relies on the representations made by manufacturers and/or suppliers. Photographs of prizes appearing in the promotional materials for this promotion may slightly differ from the actual items. The prizes are also covered by the manufacturer’s warranty and the winner should direct his/her inquiries to the manufacturer/supplier in accordance with the warranty information.
- The award of the prizes is/are subject to availability of the item/s and while supply lasts as well as the manufacturer’s/supplier’s restrictions on the same.
- During the delivery, the winner must present at least two valid identification cards and a print out of the email notification. If he/she has authorized a representative to receive his or her prize on his/her behalf, the authorized representative must present the two valid ID, the winner’s valid ID and a print out of the email notification before the item is released to the authorized representative.
- During the delivery, if both the winner and the authorized representative are not present to receive the prize, the courier will attempt to deliver the prize again. If neither one of them are present to receive the prize again, no attempt will be made to deliver the prize for the third time. In this case, the prize can only be claimed personally by the winner or his duly authorized representative at 1/F Consumer Services, Nestlé Philippines Office, # 31 Plaza Drive Rockwell Center, Makati City on a date scheduled and agreed upon. NPI is not responsible for accommodations, travel expenses or other expenses of winners when claiming prizes.
- In relation to the abovementioned paragraph, if the winner does not personally claim the prize within sixty (60) days from 01 June 2010, the prize shall be forfeited in favor of NPI, upon approval of DOH-FDA. The decision of NPI on this regard is final.
- All prizes are non-transferable and not convertible to cash.

OTHER GUIDELINES
- By registering and submitting their entries to participate in this promotion, registrant/contestant confirm, agree to and acknowledge that:
- NPI is permitted to receive his/her registration data and that all personal information supplied by him/her will be used by NPI in accordance with its privacy policy;
- He/she has the right to submit the entries for the promotion and as such holds NPI, its agencies and duly authorized representatives free and harmless from any claim by third parties for violation of privacy, violation of intellectual property rights and/or damage to reputation and other instances similar to the foregoing;
- The entries he/she submitted, whether qualified or not, shall become the property of NPI in perpetuity and without limitation as to place, purpose, use and time;
- He/she hereby assigns, and transfers unto NPI the entire worldwide intellectual property rights, title to and interest in his/her entries, including all copyright and economical rights over the same;
- He/she hereby waives his/her moral rights over the entries he/she submitted as well as to all the future adaptations and modifications of the same in favor of NPI;
- NPI shall have the right to register the copyright to the entries he/she submitted anywhere in the world without further compensation to him/her and that he/she agrees to do all the things and execute all documents necessary to effectuate such copyright registration and/or enforcement;
- As copyright owner, NPI shall have the right, without further compensation to him/her to: (a) to reproduce, distribute, adapt, modify, make available and/or communicate to the public, exhibit, or broadcast the entries he/she submitted, including any adaptation and/or performance thereof by any process, means or media, including TV, radio, satellite, cable and the Internet, without restriction of any kind as to quantity or purpose, whether commercial or otherwise, or to any country or territory in the world, without restriction as to time and place; (b) to authorize any of the above activities; and (c) to exploit any of the above commercially, by reproducing it through any media or support currently known or to come, or exhibiting it;
- From the date of submission of the entry and within the same year after joining the promotion, he/she shall not enter into a similar promotion or any promotion using the entries he/she submitted in this promotion or which would require him/her to endorse or allow his/her names, pictures or likeness, signatures, footages, voice recordings and the like, to be used as advertisement materials, in any manner, for any Competitive Product. For purposes of this Promo, Competitive Products shall refer to all coffee and other non-alcoholic beverages, whether powdered or liquid, other than those produced, manufactured, sold, and distributed by NPI. Should the restriction be violated, NPI may avail of remedies provided under existing laws including but not limited to the filing of an action for damages and/or injunction;
- NPI shall not be liable for any unauthorized use, reproduction and adaptations by third parties of any entry under this promotion which are not caused by NPI. NPI shall likewise not be liable for any unauthorized posting, use, reproduction and adaptation of the photo(s) or video(s) he/she submitted in this promotion in MMS messages, internet sites such as but not limited to “You Tube” and other similar media;
- He/she shall hold NPI free and harmless from any and all claims, suits and actions for damages or liabilities that may be brought by other persons, natural or juridical, in connection with his/her participation in this promotion as well as the statements and declarations made by him/her in relation to the promotion; and
- He/she shall make no reproduction of any part of this website for purposes of selling or distributing the same for commercial gain nor shall he/she modify or incorporate any part of the website in any other work, publication or website.
- NPI and Agency partners shall supervise, monitor and control all the activities on the NESCAFE Philippines Facebook Fan Page. However, NPI and Agency assumes no responsibility for any incorrect, inaccurate or incomplete information on the website caused by any third party, i.e., website users, hackers, among others, or caused by any of the equipment or programming associated with or utilized in the promotion. Likewise, NPI and Agency assumes no responsibility for any statement, comments or declarations made or submitted by the contestants in connection with this promotion. Said statements, comments or declarations are those of the contestants in this promotion and not of NPI and/or Agency. Further, NPI and Agency assumes no responsibility for technical, hardware or software failure of any kind, for lost network connections, garbled computer transmissions, and other problems or technical malfunctions in the conduct of this promotion. Finally, NPI assumes no responsibility for any error, omission, corruption, interruption, deletion, defect, delay in operation or transmission, communications line failure, theft or destruction, or unauthorized access to or alteration of the entries in this promotion.
- NPI and Agency assumes no responsibility for any error, omission, corruption, interruption, deletion, defect, delay in operation or transmission, communications line failure, theft or destruction, unauthorized access to or alteration of submissions of the contestants under this promotion or other similar instances that may occur in connection with or in relation to this promotion.
- NPI, its parents, affiliates, subsidiaries and related companies, its advertising or promotion agencies, or its officers, directors, employees, shareholders, representatives or agents shall not be responsible or liable for any damages or losses of any kind, including direct, indirect, incidental, consequential, special or punitive damages arising out of any access to and use of the NESCAFE Philippines Facebook Fan Page. Without limiting the generality of the foregoing, everything on the website is provided “as is”, without warranty of any kind, either express or implied, including but not limited to, the implied warranties of merchantability, fitness for purpose or use or non-infringement.
- The occurrence of force majeure or any event beyond the control of NPI that will make it impossible for NPI to continue with the conduct of the promotion, i.e. programs are not capable of running as planned, including infection by computer virus, bugs, tampering; unauthorized intervention; technical failures; technical malfunction of any telephone network or lines, computer on-line systems, servers, computer equipment and software; failure of any e-mail account to transmit message to NPI on account of technical problems, human error or traffic congestion on the internet or any website; injury or damage to the participant’s or any other person's computer due to or resulting from participating in the promotion or downloading any materials from the See the Difference website; or any other causes which corrupt or affect administration, security, fairness, and integrity of selecting the contestants in this promotion, shall entitle NPI to cancel, discontinue or suspend this promotion upon approval of FDA.
NPI, Virus Inc., Proximity, Deploy-Digital, Publicis and other official media partners and sponsors' employees and their relatives up to the third degree of consanguinity are disqualified from the contest.
